Details of the President's communiqué that no business license is required
The decision of the Supreme Administrative Council to simplify the process of starting a business was announced by the President.
According to the International Stone Exhibition of Iran, the Supreme Administrative Council in the one hundred and eighty-sixth session dated 24/9/1399 according to the proposal of the Administrative and Employment Organization of the country and citing paragraph 10 of Article 115 of the Civil Service Management Law) in order to facilitate and expedite Service delivery, Creating transparency and reducing corruption in service processes, approved the plan to "simplify the process of starting a business" as follows:
Article 1- The executive bodies in charge of or issuing licenses in order to start a new business are obliged to pay attention to the following items and to modify the licensing processes accordingly:
1-1- All requirements, instructions and standards appropriate to the relevant type of business and the laws and regulations approved and governed, by the licensing authority and publicly inform the stakeholders and trade unions, so that business applicants Be able to submit their application to start a business without any preconditions and during the administrative process.
Note: Informing the beneficiaries as well as registering the application to start a business by the applicants is done electronically.
2-1- In order to start a business, the applicant, if he / she observes the requirements, instructions, standards and laws and regulations approved by the ruler, can declare and comply with them in a self-declared manner and in accordance with the legal requirements. Self-declaration means acceptance of all the terms and conditions of the declaration and commitment to their full implementation, and in the case of the above-mentioned standards, the right to revoke the activity license is reserved for the competent authorities.
3-1- After the submission of the mentioned obligation by the applicant, the "start of activity" license should be issued immediately. The body in charge of issuing a business start-up license is obliged to send the business applicant's start-up license and commitment letter to the Ministry of Economic Affairs and Finance and the relevant supervisory bodies (as the case may be).
Article 2 - Any application of forecasting opinions by the monitoring devices and postponing the start of the business to carry out these monitoring stops and the monitoring devices in accordance with the scope of their supervisory duties in any type of activities, by performing the required pin monitoring, to comply with the steps. Start a business with the requirements, instructions, standards and laws and regulations approved and governed by the designated and committed to act and notify possible violations identified during supervision to the relevant licensing authorities.
Article 3 - Licenses and inquiries related to important and effective activities in the fields of treatment and security and other special cases, at the discretion of the Deregulation Board and facilitating the issuance of business licenses, are excluded from the scope of this resolution.
Article 4- Supervision of the proper implementation of this decree by the executive bodies is the responsibility of the Ministry of Economic Affairs and Finance.
Article 5 - The highest official of the relevant executive body is responsible for the proper implementation of this decree and the report on its implementation shall be submitted to the council by the Secretariat of the High Administrative Council.
