Establishment of check buying and selling gangs due to the Central Bank's disregard for the full implementation of the law
For some time now, the arrest of various fraudulent gangs in the field of counterfeiting and buying and selling checks has increased in the country. This situation is expected to continue until the new law on the issuance of checks by the Central Bank is fully implemented.
According to the International Exhibition of Iranian Stone; Nearly two months have passed since the news of the arrest of a Czech sales gang at one of the country's northeastern airports. The violations committed by this gang were so severe and numerous that the type of activity of these people quickly reached the main news in cyberspace and media.
In a similar incident and with the vigilance of the country's law enforcement and security officials, another gang that was active in the field of buying and selling occasional checks and forging checks and documents was recently caught in the northwest of the country. In this regard, the Ministry of Intelligence announced the arrest of 15 people from an organized gang of fraudulent sales of bank checks, and also announced that more than 45,000 returned checks worth 13,000 billion rials had been discovered from this gang. These individuals were monitored and arrested in East Azerbaijan Province by the General Directorate of Intelligence.
The root of these violations is the non-implementation of the new law on the issuance of checks by the Central Bank, which allows fraudsters to use the holes in the non-compliant sections of the law to engage in illegal activities, including buying and selling case checks.

Fraudulent purchase and sale of case checks is a solution for fraudsters and profiteers who use it, without accepting the legal responsibility of signing the check and by paying a small fee for the number written on the check, make a large number of purchases or checks in the fastest time. Delivery on bail, without having to settle the check on time. This method allows anyone to harm a large number of uninformed people and cause a lot of economic and social damage without worrying about the legal consequences of returning a check.
The way these money laundering gangs work is that with a precise process and using the gaps in the unimplemented sections of the new check issuance law, these people use strategies to issue checks to addicted or homeless people, for example. For these people, they get a fake business license and then, in contact with the heads of some bank branches, they receive checks for those people, and then, by paying a small amount of money to these low-income people, they collect checks together and then each of these tools. They sell long-term finances at exorbitant prices.
In another method, these money laundering gangs counterfeit checks by forging checks using a batch of unused checks that have a unique code and inserting the unique code of the original checks on these fake checks. This makes everything look normal and traded when the unique code is queried.
People who buy these checks are also free to write whatever amount is needed on the check and deliver it to the other party in the transaction. Depending on the date of receipt of the check, the original owner of the check will block the account one or more days before the time of receipt and therefore the check will no longer be settled.
* Full implementation of the new check law by the Central Bank is the only way to prevent these violations
As mentioned, in order to prevent these violations, the Central Bank should implement the new law on issuing checks, which was approved in December 1397, and for this purpose, implement a systematic registration of checks, electronic check law and information symmetry. It can prevent these violations.
According to the new law on issuing checks and the schedule provided for in it, the last tasks of the law must be operational by December of this year, while the Central Bank is very weak in implementing 12 of the tasks of the new law on issuing checks that should be operational by December of last year. Of these 12 cases, only 3 have been fully implemented.
Certainly, the non-full implementation of the new law on issuing checks will allow fraudsters and profiteers to continue their violations with less risk and more comfort, and in this way, to make big profits. The smoke of this negligence and underemployment will also increase in the first place. The eyes of the people are gone and it will continue to suffer great losses for the society and the financial and judicial system of the country.
